Policies
1. DAMAGE PAYMENT
A Damage Deposit of $0 (at this time) will be held in a non-interest bearing account. Applicable Damage deposit will be returned to the GUEST within (14) days after termination of this agreement. All or part of the security may be withheld in the event of: property damage, missing items, excessive cleaning required, excessive utility charges incurred, and/or charges incurred due to pets, contraband, smoking, exceeding occupancy. In such an instance, the GUEST will be notified within (10) days of vacating the property as to the amount withheld and the reason. The Damage Deposit shall in no way be used as a rental payment. The Damage Deposit Payment is not the same as the Booking Payment.
2. FALSIFIED RESERVATIONS
Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in, or the party will be required to leave. This includes the number of guest which cannot exceed 12 people, as well as a form of student groups, even those with an adult “supervision.”
3. CLEANING
The stated Cleaning Fee includes only the cost of specified cleaning services engaged at the end of GUEST’s rental term.
4. OCCUPANCY
Occupancy includes all guests that stay overnight at the property. Occupancy may not exceed the number of people included in Guest's Booking. Occupancy calculation includes children age 2 and above. Visitors of the GUEST are NOT permitted on the property, this includes the use of the pool. If GUEST exceeds the maximum occupancy, then all GUEST are subject to immediate removal and forfeiture of security deposit and rental payment.
5. CHECK-IN/CHECK-OUT
The check-in time is 4:00 PM or after. The check-out time is 10:00 AM. GUESTS agree to such time periods so the property can be hygienically cleaned and maintained for the next guest.
6. ENTRANCE CODE
Entry Code will be provided by the OWNER upon your arrival and rental payment is paid in full.
7. CANCELLATION POLICY AND FEES
Cancellations prior to 45 days before check-in will receive 100% refund. Cancellations from 30 to 45 days before check-in receive a 50% refund. Cancellations 0 to 30 days before check-in will not receive a refund. As the OWNER, I will immediately put the house back on the market for rent. In the event you cancel after the 100% refund, if successfully rented at the same rate, I will refund your money less a 15% cancellation fee. We strongly recommend you purchase travel insurance that covers this situation.
8. PETS
The Property does allow pets with a maximum of two per household. There is a $100 non refundable fee which will be charged. This fee is only for cleaning purposes and any damage to the house proper, upholstery, drapery , doors , trim , etc as the result of a pet will be taken out of the damage deposit.
9. SMOKING POLICY
The house is smoke free. Absolutely No smoking is allowed inside the home. You are allowed to smoke outside on the porches and on the premises so long as the ashes and butts are contained and disposed of in the trash.
10. MAINTENANCE & REPAIRS
It is expected that major systems in and around the house will break down from time to time (i.e. air conditioning, washer, dryer, refrigerator, pool equipment, etc.) The OWNER will attempt to repair the problem as soon as possible upon the GUEST notifying the OWNER. No rent adjustment can be made for circumstances beyond our control, malfunctions or loss of use of equipment or amenities. OWNER assumes no liability to GUEST if such should occur, as all products have a useful life and break down occasionally.
11. ACCESS
The Owner has the right of entry in emergencies, or to protect or preserve the premises. Guests shall not alter or add locks. Any authorized repair person may enter the premises during customary business hours for any purpose related to the repair, care, improvement, and management of the premises. The OWNER will give the GUEST prior notice if possible.
12. INVENTORY/INSPECTION, DAMAGES AND MISSING ITEMS
Prior to check-in the premises have been inspected/inventoried. Guest is responsible for notifying Owner immediately upon check-in if the Rental Property is found in less than good condition or any damage (other than normal wear and tear). If damages occur during your stay, please notify us immediately. After Guest vacates, inspection/inventory is performed, Guest will be notified of any damage/costs or missing items. Guest assumes full responsibility for any items damaged due to misuse or negligence and for any items missing. All damage charges will be deducted from the GUEST Security Deposit. Any Damages exceeding Guest Security Deposit amount will be charged to the GUEST.
13. END OF TERM
At the end of the term, the GUEST shall leave the premises clean and in good condition, and remove all GUEST property. No holding over or late departure without prior approval.
14. HURRICANE/WEATHER EVACUATION POLICY and UNFORESEEN CONDITIONS
If you are traveling between May and December, please note that this is hurricane season with the peak between mid-august to mid-October. No refund shall be given for cancellations due to expected poor weather conditions, severe weather, road closures, traffic delays, early departures, or illness or injury. In the event of a mandatory evacuation due to hurricanes, where you are required by law to vacate property, you will be refunded for the appropriate days, less a 15% processing fee. If for any reason the premises are condemned by any governmental authority, or destroyed through fire, act of God, nature or accident, this rental agreement shall cease and shall terminate as of the date of such condemnation or destruction and Guest hereby waives all claims against Owner for any damages suffered by such condemnation or destruction. It is highly advised for guests to purchase Travel Insurance that covers these situations.
15. ILLEGAL DRUGS
Under no circumstances shall any illegal drugs be allowed on the property and no underage drinking. GUEST understands that possession and use of any such substance, or underage drinking is grounds for immediate eviction and forfeiture of refund. GUEST further waives any and all rights to recourse against the OWNER for enforcing this clause.
16. NO STUDENT GROUPS PERMITTED
Students or persons 25 and under, unaccompanied by a parent will not be permitted to register. This includes groups where one of them is a parent or adult that books for a group under the age of 25. Any reservation obtained under false pretense will be subject to forfeiture of all monies prepaid and the party will not be permitted to occupy.
17. PEST
The house is treated for pests. However, the Owner cannot control nature and the outside coastal environment. It is highly advised to keep all doors and windows closed at all times to prevent flying insects from entering the house. The Owner will make best efforts to address pest control concerns, but is not responsible for rebates due to the presence of pests, or in the event of untimely service by pest control company. It is highly advisable to bring insect repellent.
18. INTERNET SERVICE
The house is equipped with wireless high-speed internet service. The password will be provided upon arrival. Internet service is fairly reliable but not guaranteed. Notify OWNER of any issues so I can address them ASAP.
19. SAFETY
GUEST acknowledges and agree that they are responsible for the safety of themselves, any guests and children with respect to the house, grounds, gulf, pool and canal. There is no lifeguard and pool supervision is GUEST responsibility.
20. HOLD HARMLESS
The GUEST and their Guests shall hereby indemnify and hold harmless the owner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Guest expressly recognize that any insurance for property damage or loss which the owner may maintain on the property does not cover the personal property of Guest, and that Guest should have their own insurance if desired.
21. SURVIVAL
If any clause or term in this lease is contrary to law, the reminder of the Lease shall remain in full force.
GUEST have read and agree to the conditions and policies set forth in the Rental Agreement including House and Pool Rules Attachments, thus agrees to the terms, and will comply with them during the course of this vacation rental.
