GUEST RENTAL INFORMATION AND AGREEMENT (PAGE 1 of 2) – PLEASE READ CAREFULLY
There are no refunds for late arrivals and/or early departures.
You will be held financially responsible for any and all damages and or missing inventory during your stay, up to and above your deposit or damage insurance policy amount. A full inventory is done before your check in and after your check out.
If it is determined that there were more than four (4) people occupying the home, you will be charged $500 per person, per night, over the maximum guests allowed.
NO SMOKING and NO PETS are allowed. If it is determined that there was smoking or pets in the home, we will have to clean the floors, furniture and wash all bedding; we will pass that charge on to you; the smoking/pet cleaning fee is a minimum of $500 up to $1000 depending on severity and rooms affected. This is necessary due to the fact that some people are allergic to pets and tobacco smoke.
You agree to be responsible for and to pay in full any and all attorney’s fees, costs, filing fees, court costs, collection fees, and any other expenses incurred in any litigation, arbitration, collection, or any other proceeding, by which Jonathan Speegle, the owners of the premises, and/or their representatives, seek to enforce their rights under this agreement (whether in contract, tort, or both) or seek a declaration of any rights or obligations under this agreement.
Advertised amenities are not guaranteed and may not be available at your time of visit, such as a pool, a hot tub, TV, etc, might be down for maintenance. There are no refunds or compensation of any type due to an amenity not being available. We realize you might choose your property based on amenities and we will do our best to make sure they are working and available upon your visit, but sometimes it is out of our control. Your rental rate pays for the property you are renting, not the extra amenities, they are considered a bonus.
We ask that you leave the home in good clean condition (run dishwasher, take trash out and replace furniture to its original position,) or it may be necessary to charge you an additional cleaning fee. These charges will occur if upon final inspection following your departure it is determined that any of the above has occurred. Please do not make any of the beds that have been used. When you leave: make sure all doors and windows are locked; all lights, TVs, etc. are off; and thermostat is set to 78 degrees.
All of the following are strictly prohibited, and violating any of these prohibitions will result
in immediate eviction and forfeiture of all rent:
• Occupancy exceeding 4 persons, OR by any person(s) not named on the rental
agreement, OR by any person(s) not named on the Waiver of Liability and Hold
• Groups comprised of persons under the age of 25;
• Holding parties;
• Public drunkenness or the possession, provision, or use of alcoholic beverages by or to
persons under the age of 21;
• Possession, provision or use of illegal drugs or activities;
• Excessive noise before 9 AM and after 9 PM;
• Causing damage of any kind to the home, amenities, or any neighboring properties;
• Violation of local, state, or federal law.
WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT (PAGE 2 OF 2)
IN CONSIDERATION for being permitted to rent and or occupy the property located at 6851 Lakeshore Drive, Gulf Shores Alabama, for vacation rental or any other purpose, the undersigned, for himself/herself, his/her personal representatives, guests, children, heirs, and next of kin, acknowledges, agrees, and represents that he/she has or will immediately upon entering, and will continuously thereafter, thoroughly inspect such areas, and his/her continued presence constitutes an acknowledgement that he/she has inspected house, deck, and entire property and he/she finds and accepts such areas as being safe and reasonably suited for the purposes of his/her use, and he/she further agrees and warrants that if, at any time, he/she feels anything to be unsafe, he/she and all guests will immediately leave the area and advise appropriate persons.
THE UNDERSIGNED hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT SUE, Jonathan Speegle, the owners of the premises, their representatives, members, managers, operators, officials, officers, directors, employees, all for the purposes herein referred to as “releasees”, for all liability to the undersigned, guests, representatives, assigns, heirs and next of kin, for any and all loss of damage, and any claim or demand thereof on account of property damage, illness or INJURY to the person(s), or resulting in DEATH of the undersigned or guests, whether caused by negligence of the releasees or otherwise while in or upon the area.
THE UNDERSIGNED hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area and whether caused by the negligence of the releasees, natural risky conditions, or otherwise.
WARNING; Use of any hot tub and/or pool carries risk that may result in serious injury or death. NO CHILREN UNDER THE AGE OF 12 ARE PERMITTED TO USE THE HOT TUB AT ANY TIME. The American College of Obstetricians and Gynecologist (ACOG) state that becoming overheated in a hot tub is not recommended during pregnancy. Elderly persons and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy or similar afflictions should not enter the hot tub without consulting their physician. Never use a hot tub and/or pool while under the influence of drugs or alcohol or if you are taking medications of any kind, or being treated for any illness. The hot tub should be kept at a temperature less than 104 degrees for personal safety and all bathers must shower before and after use to decrease the possibility of skin problems. DO NOT SIT OR WALK ON THE HOT TUB COVER, or it will collapse. Supervise children at all times to decrease risk of injury, death or drowning. The undersigned and their guests shall ensure that the hot tub, and/or pool are used in a safe manner at all times and that non-adult use of the hot tub, and/or pool is supervised by a qualified and capable adult. THE PROPERTY IS NOT CHILDPROOF and thus requires children to be supervised by an adult at all times. Amenities such as furniture with sharp edges, games with small pieces, knives, cleaning products, spa and pool chemicals and other examples known and unknown pose safety issues for children. The undersigned and their guests claim understanding, acceptance and responsibility for these risks upon entering.
DANGER: There are many risks and dangers inherent to this wetland/ocean terrain that could jeopardize both health and life, specifically including but not limited to perilous mud, wildlife, and fast moving currents of water. Walking on paths, the beach, or swimming in the ocean is at your own risk. Each person who arrives on the property does so at their own risk and accepts full liability and responsibility for that risk and whatever occurs to them while they are on the property. Each child who arrives on the property must have a guardian and that guardian accepts full liability and responsibility for the care and welfare of that child. The property owners cannot be held liable or responsible for harm to you or other individuals from your carelessness, the carelessness of the individual harmed, or the carelessness of others. The property owner cannot be held liable or responsible for any harm or damage caused by acts of nature or God. Each person accepts full liability and responsibility for their own actions and their own possessions. By accepting permission to rent and or occupy, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
THE UNDERSIGNED hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to the negligence of the releasees, or otherwise while in or upon area.
THE UNDERSIGNED hereby certifies that he/she and guests (they) have adequate insurance to cover an injury or damage that may be caused or suffered while in or upon area, or else agrees to bear the costs of such damage or injury. The undersigned further certifies that he/she/they have no medical conditions which would interfere with use of the spa, wetland/beach terrain or ocean or else assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or death and/or property damage.
IN SIGNING THIS RELEASE, (or if reserving online by checking on the I agree box, or by making any payment to the releases, or by entering the property) I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same. The undersigned further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
